Terms of Service & Privacy Policy
Effective: 12 April 2026. These terms govern your use of Red Kite at https://redkitematch.com.
1. Definitions
"Red Kite", "we", "us" — the operator of https://redkitematch.com.
"Service" — the Red Kite web application, APIs, and related features for tender discovery, scoring, and bid qualification.
"User" or "you" — any individual or organisation that registers for or uses the Service.
"Procurement Data" — public tender notices sourced from Find a Tender (FTS), Contracts Finder, and TED (Tenders Electronic Daily).
"Profile Data" — information you provide about your organisation, including business description, keywords, and sectors.
2. The Service
Red Kite aggregates Procurement Data from public government sources and uses automated scoring — including machine learning embeddings and large language model (LLM) analysis — to rank those opportunities against your Profile Data.
The Service is provided on a best-efforts basis. We do not guarantee uninterrupted availability, and we may modify or discontinue any feature at any time with reasonable notice.
3. Eligibility & Registration
You must be at least 18 years old and acting on behalf of a legitimate business or organisation to use the Service. Consumer email accounts (e.g. Gmail, Hotmail) may be restricted; business email addresses are required.
You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.
4. Acceptable Use
You agree not to:
- Scrape, bulk-download, or systematically extract Procurement Data from the Service for redistribution
- Use the Service for any unlawful purpose or in violation of applicable procurement regulations
- Attempt to reverse-engineer or circumvent any security or rate-limiting measures
- Submit false, misleading, or harmful Profile Data
- Misuse the flag/report feature to suppress legitimate opportunities
5. Data Accuracy Disclaimer
Procurement Data is sourced from third-party government systems and is reproduced without modification. We do not warrant the accuracy, completeness, currency, or fitness for purpose of any tender notice displayed on the Service.
Tender details including deadlines, values, scope, buyer contact information, and eligibility criteria may contain errors, may be updated or withdrawn on the source platform without notice, and may differ from the authoritative published version.
You must independently verify all tender information directly with the contracting authority before taking any action, including submitting a bid. Red Kite accepts no liability for any loss arising from reliance on inaccurate, incomplete, or outdated Procurement Data.
AI-generated fit scores, match summaries, and explanations are estimates only — see section 6.
6. AI-Generated Content
Fit scores, match reasons, risks, summaries, and explanations are generated by automated systems including embedding models and large language models (currently Groq / Llama and OpenAI). These outputs:
- May be inaccurate, incomplete, or misleading
- Do not constitute a professional assessment of your eligibility or suitability for any contract
- May reflect biases or limitations inherent in the underlying models
- Are not a substitute for your own expert review
A high fit score does not guarantee you will win, or are eligible for, the contract. A low fit score does not mean you are ineligible. Always read the full tender documents.
7. No Professional Advice
Nothing on the Service constitutes legal, procurement, financial, or commercial advice. Red Kite is an information and discovery tool only. For advice on bid strategy, compliance, or contract terms, consult a qualified procurement professional.
8. Limitation of Liability
To the maximum extent permitted by applicable law:
- The Service is provided "as is" without warranty of any kind, express or implied
- We are not liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost bids, or lost business opportunities
- Our total aggregate liability to you for any claim arising out of or relating to the Service shall not exceed the amount you paid us in the 12 months preceding the claim (or £100 if no amount was paid)
- We are not liable for the content, accuracy, or availability of any third-party procurement platform (Find a Tender, Contracts Finder, TED)
Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by law.
9. Intellectual Property
The Service software, design, and original content are owned by or licensed to Red Kite. Procurement Data originates from public government sources and is subject to the Open Government Licence v3.0 and equivalent EU open-data licences.
You retain ownership of your Profile Data. By submitting Profile Data, you grant us a non-exclusive licence to use it solely to operate and improve the Service (including training embeddings for your own scoring — never shared with other users).
10. Suspension & Termination
We may suspend or terminate your account if you breach these terms, engage in abuse, or at our discretion with 14 days' written notice for any other reason. You may delete your account at any time by contacting us at [email protected].
On termination, your Profile Data will be deleted within 30 days.
11. Privacy & Data Processing
We are the data controller for personal data processed through the Service. We process the following categories of personal data:
- Account data — email address, name, organisation name (collected via Clerk)
- Profile data — business description, keywords, sectors, contract value preferences
- Usage data — pages visited, features used, opportunity interactions (PostHog)
- Error data — technical errors and stack traces (Sentry)
- Push notification tokens — if you opt in to browser notifications (OneSignal)
Legal basis: Contract performance (operating the Service you registered for) and Legitimate Interests (service improvement and fraud prevention). We do not rely on consent for core processing, but we will ask for consent where required (e.g. push notifications).
We do not sell your personal data to third parties.
Your business description, keywords, and sector preferences are sent to third-party AI providers (see section 12) to generate match scores and explanations. Your company name is not transmitted to any AI provider.
12. Third-Party Sub-processors
We use the following sub-processors. By using the Service you acknowledge that data may be transferred to these providers in accordance with their own data processing agreements:

For US-based providers, transfers are conducted under Standard Contractual Clauses (SCCs) or the provider's applicable data processing agreement.
14. Data Retention
We retain your data for as long as your account is active. On account deletion:
- Profile Data — deleted within 30 days
- Opportunity scores and saved notes — deleted within 30 days
- Aggregated/anonymised usage statistics — may be retained indefinitely
- Error logs — retained for up to 90 days
15. Your Rights (UK GDPR)
Under UK GDPR you have the right to:
- Access — request a copy of your personal data
- Rectification — correct inaccurate data
- Erasure — request deletion ("right to be forgotten")
- Portability — receive your data in a machine-readable format
- Restriction — restrict processing in certain circumstances
- Object — object to processing based on legitimate interests

You also have the right to lodge a complaint with the Information Commissioner's Office (ICO).
16. Changes to These Terms
We may update these terms from time to time. Material changes will be notified by email or by a prominent notice in the app at least 14 days before taking effect. Continued use of the Service after the effective date constitutes acceptance of the revised terms.
17. Governing Law
These terms are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
